1. About these Terms
These Terms of Service ("Terms") are a binding agreement between you and My True Holiday LLC, a Wyoming limited liability company ("My True Holiday," "we," "us," or "our"), with a business address at 24 Mercer Street, 2nd Floor, Suite 223, New York, NY 10013. They govern your use of our website and your purchase of any vacation package or certificate we offer.
By using this site, submitting an inquiry, or buying a package, you agree to these Terms. If you do not agree, do not use the site or buy from us. The version in effect on the date of your purchase governs that purchase.
2. What we do
My True Holiday sells discounted vacation packages at name-brand, all-inclusive resorts. You purchase a vacation package (in some cases issued as a certificate) for a stay at one of the resorts we offer. After you buy, our team contacts you by phone to confirm your resort and travel dates, subject to availability.
We are a seller and coordinator of these packages. We are not the resort, the hotel operator, an airline, or a travel insurer. The resorts and their amenities are owned and operated by independent third parties, and a fulfillment partner helps place and service your reservation (see Section 9).
3. Eligibility and qualification
Our packages are available only to people who meet the qualification requirements for the offer. We confirm your eligibility before your purchase is final, through a short questionnaire. The full criteria are shown to you in that questionnaire; we do not list all of them here.
At a high level, to qualify you generally must:
- be within the offer's eligible age range;
- hold a valid major credit card in your own name;
- if married or living with a partner, plan to attend the resort presentation together (see Section 4); and
- be able to communicate in English and meet residency and other conditions shown in the questionnaire.
If you do not qualify before purchase, we will not complete the sale, or we will refund you or help you find an alternative; you are not charged a penalty for being screened out up front.
If you do not qualify or do not attend the presentation once at the resort (for example, you do not meet the conditions at check-in, or you skip the presentation), the resort may charge your card on file as described in Section 4.
4. The package, the stay, and the resort presentation
What's included. Each package lists what it includes at the time of purchase. Inclusions are part of the package as described and are not separately redeemable for cash.
Booking and availability. Your specific resort, room category, and dates are confirmed with you after purchase and are subject to availability. Travel is not guaranteed for any specific date until confirmed.
Resort presentation. Every package includes one resort presentation of approximately 120 minutes during your stay, typically the morning after your arrival day. It is a hosted tour of the property and its amenities, hosted by the resort's team. Attending is part of the package. If you are married or traveling with a partner, you both must attend together.
Non-attendance or not qualifying at the resort. If you do not attend the presentation, or you do not meet the qualification requirements at check-in, the resort (not My True Holiday) may charge a fee directly to the card you provide at check-in. That fee and its terms are set by the resort and are disclosed in the agreement you sign before travel.
Identification and conduct. You must present valid government-issued identification at check-in and comply with the resort's policies during your stay.
5. Prices and payment
Prices are shown in U.S. dollars unless stated otherwise and are the prices in effect at the time you buy. The package price holds for the period stated at purchase and does not change after you commit.
By providing a payment method, you authorize us and our payment processors to charge the full amount of your purchase. We use third-party processors (which may include Stripe and, where applicable, Openpay/BBVA) to handle payments; your payment is also subject to their terms. You are responsible for any applicable taxes or charges imposed by the resort, a government, or your card issuer that are not part of the package price.
6. Cancellations, refunds, and changes
Our policy. Vacation packages are non-refundable, except as described below or as required by law. We do not offer refunds for buyer's remorse, missed travel, or no-shows once travel is booked.
Your right to cancel (where the law provides one). You may cancel your purchase for a refund within three (3) days of your purchase date. If you are a Florida resident, you may cancel within thirty (30) days of your purchase or of receiving your vacation certificate, whichever is later, as required by Florida law. Some other states and provinces give their own cancellation rights; where they apply, we honor them. To cancel, contact us at support@mytrueholiday.com within the applicable period.
Changes instead of refunds. Before your travel is booked, you may ask to change your travel dates or your resort, subject to availability and resort rules. This is our primary way to accommodate a change of plans.
If we cannot place you. In the rare event we are unable to provide you with an available resort, we will work with you on alternatives or, at our discretion, refund you.
After the cancellation period and after booking. Once any applicable cancellation period has passed and your travel is confirmed and booked, your purchase is non-refundable.
7. Required disclosures
This advertising material is being used for the purpose of soliciting sales of a vacation club.
8. Messaging and calls (SMS / TCPA)
When you provide your phone number and check the consent box, you give prior express written consent to receive recurring automated and prerecorded marketing and informational calls and text messages from My True Holiday and its service providers and partners at the number you provide, including by automatic telephone dialing systems and artificial or prerecorded voice.
- Consent is not a condition of any purchase.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out at any time, and HELP for help. We honor opt-out requests made by any reasonable means and process them promptly (no later than 10 business days).
- Opting out of marketing messages does not stop transactional messages needed to service a purchase you have made.
- Carriers are not liable for delayed or undelivered messages.
We do not share your mobile opt-in or consent with third parties for their own marketing. See the Privacy Policy for how we handle the underlying data.
9. Resorts, suppliers, and third-party services
The resorts and any transportation, activities, or other services connected with your stay are provided by independent third parties. My True Holiday is not responsible for the acts, errors, omissions, or policies of any resort, hotel, carrier, or other supplier, including changes to amenities, closures, overbooking, or service quality. Your stay is also subject to the resort's own terms.
Your vacation package includes a Travel Assistance Plan provided by NEKELA (UVC TravelShield). It covers services such as phone and online medical assistance, ground ambulance, emergency dental care, medical or funeral repatriation, transportation of a family member during medical convalescence, an extended-stay allowance for convalescence, legal assistance by phone, early-return expenses in an emergency, and online veterinary assistance. This is a travel assistance plan, not travel insurance. 10. Acceptable use
You agree not to misuse the site: no unlawful use, no attempts to interfere with or compromise the site or its security, no scraping or automated data collection without permission, and no use of our content except as allowed below.
11. Intellectual property
The site and its content, including text, design, logos, the "My True Holiday" name and marks, and images, are owned by My True Holiday or its licensors and protected by law. We grant you a limited, personal, non-transferable license to view the site for your own non-commercial use. You may not copy, reproduce, or use our content or marks without our written permission. Resort names, logos, and program marks displayed on the site belong to their respective owners and are used with authorization for the limited purpose of describing the packages we offer. Their appearance does not imply endorsement of My True Holiday.
12. Disclaimers
The site and our packages are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any resort experience will meet your subjective expectations.
13. Limitation of liability
To the fullest extent permitted by law, My True Holiday and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or loss of data, arising out of or relating to the site, a package, or your stay. To the fullest extent permitted by law, our total liability for any claim relating to a purchase will not exceed the amount you paid us for that purchase. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless My True Holiday and its members, officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the site, your violation of these Terms, or your violation of any law or third-party right.
15. Dispute resolution, governing law, and arbitration
Informal resolution first. Before starting any formal proceeding, contact us at support@mytrueholiday.com and give us 30 days to resolve the issue.
Governing law. These Terms are governed by the laws of the State of Wyoming and applicable US federal law, without regard to conflict-of-laws rules.
Binding arbitration. Except for the carve-outs below, any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, governed by the Federal Arbitration Act. The AAA Rules and fee information are available at www.adr.org. If your claim is for $75,000 or less, My True Holiday will pay all AAA filing, administration, and arbitrator fees; if your claim exceeds $75,000, fees will be allocated as the AAA Rules provide. The arbitrator may award the same relief that a court could, but only on an individual basis. The arbitrator's decision is final and binding and may be enforced in any court of competent jurisdiction.
Class-action waiver. Disputes will be arbitrated only on an individual basis. You and My True Holiday waive any right to bring or participate in a class, collective, or representative action.
Carve-outs. Either party may bring an individual claim in small-claims court and may seek injunctive relief to protect intellectual property.
Opt-out. You may opt out of arbitration by writing to support@mytrueholiday.com within 30 days of your first purchase.
16. Changes to these Terms
We may update these Terms. When we do, we will change the "Last updated" date below and, where appropriate, give additional notice. Continued use after an update means you accept the revised Terms.
